CCP Targets Misleading Real Estate Marketing, Calls August 27 Hearing on NOC Claims and Hidden Charges

The Competition Commission of Pakistan will hold an open hearing on 27 August 2026 to hear stakeholders and examine competition concerns in the real estate sector, particularly false or misleading claims, hidden charges and misrepresentation of project approvals, according to an official CCP press release dated 18 August 2026. The hearing follows complaints received by the Commission regarding deceptive and anti competitive practices in the sector.
What the Hearing Will Cover
CCP has stated it has observed that claims relating to project approvals, features, charges and other material information can significantly influence investment decisions, and that where consumers invest substantial amounts on the basis of false or misleading representations, the consequences can be serious. The Commission has invited consumers, investors, developers, builders, real estate professionals, industry associations and other stakeholders to share their experiences and concerns directly, framing the exercise as necessary for identifying broader competition concerns and understanding market practices from the perspective of both consumers and businesses.
The Legal Basis
The hearing is being held under Section 29(c) of the Competition Act, 2010, which empowers the Commission to hold open hearings on matters affecting competition. Deceptive marketing practices, including the dissemination of false or misleading information that may harm consumers or the business interests of other undertakings, are separately prohibited under Section 10 of the same Act. Submissions and concerns raised by participants at the hearing will be recorded and considered by the Commission in formulating its eventual Opinion and recommendations for the sector, rather than resulting in an immediate enforcement order from the hearing itself.
When and Where
The hearing will run from 4:00 pm to 6:00 pm on Thursday, 27 August 2026, at the Competition Commission of Pakistan's offices on the 9th Floor, ISE Towers, Jinnah Avenue, Islamabad. Registration is mandatory and closes on 25 August 2026, with participants able to register by emailing [email protected] or contacting the Commission directly at 051-9100260, extensions 334 or 273.
Why CCP Is Doing This Now
This isn't the Commission's first intervention in real estate marketing, and the hearing announcement itself notes that CCP has already undertaken enforcement actions, conducted enquiries and passed orders involving deceptive marketing practices in the sector. One of the clearest precedents is CCP's Rs150 million penalty against Kingdom Valley for misleading advertising, issued in 2025. In that case, the Commission's Office of Fair Trade found the company had falsely advertised its project as Kingdom Valley Islamabad despite the project actually being located in Mouza Choora, Tehsil and District Rawalpindi, had misrepresented affiliations with the Naya Pakistan Housing Program and the Naya Pakistan Housing and Development Authority, and had publicised the project as NOC Approved without accurate or complete disclosure of its actual approval status. The Commission fined the company Rs75 million for each of two separate violations of Section 10 of the Competition Act, and separately flagged the company's failure to submit audited financial statements as a governance concern. This case was later upheld on appeal before the Competition Appellate Tribunal, and other real estate related penalties, including against DHA Lahore, have similarly been upheld at the tribunal level.
What This Signals for the Sector
Rather than pursuing another single company enforcement action, CCP's decision to hold a sector wide open hearing suggests the Commission wants to understand the scale and pattern of misleading marketing practices across the real estate industry as a whole, potentially informing broader policy recommendations rather than isolated penalties alone. The specific categories flagged in the announcement, misleading claims about project approvals or NOC status, hidden charges, and misrepresented project features, map directly onto the kinds of violations already established in prior CCP enforcement actions like the Kingdom Valley case, suggesting these are recognised, recurring patterns rather than hypothetical concerns.
What This Means for Buyers, Investors and Developers
Buyers and investors who believe they were misled by false NOC or approval claims, undisclosed charges, or inaccurate project feature representations should treat this hearing as a genuine opportunity to have their experience formally recorded by the regulator, and should consider registering to participate before the 25 August deadline if they have relevant evidence or complaints to share. Developers, builders and industry associations likewise have a direct interest in participating, both to represent legitimate industry practices and because the Commission's eventual Opinion could shape future regulatory expectations for how projects are marketed nationwide. For any current or prospective real estate purchase, this is also a useful reminder to independently verify NOC and approval claims directly with the relevant development authority, such as CDA, RDA, LDA or the applicable provincial land records authority, rather than relying solely on a developer's advertised claims, given CCP's own stated basis for holding this hearing.
