At a Glance: Most KDA plots are 99-year leaseholds, not freehold. A registered lease is strong protection that KDA cannot cancel by letter. Check the lease date and remaining term, clear ground rent, confirm sub-leases for flats need SBCA’s completion plan, and extend short leases before selling or seeking bank finance.

KDA Lease Guide

Karachi

Most plots in Karachi Development Authority (KDA) schemes are not owned outright. They are held on a lease from KDA, usually for 99 years, and the lease is what gives the holder a registered right over the land. It decides what the plot can be used for, whether it can be mortgaged or sub-leased, and how long the holder's rights last.

For buyers, the lease is the strongest single document in a KDA file. Our guide on how to verify property in Karachi explains that KDA holds the land layer for much of Karachi, and within that layer the lease is the point where an allotment becomes a registered title. A plot with a valid lease is a very different asset from one held only on allotment and transfer orders.

This guide explains what a KDA lease is, how it is executed, what it costs, how sub-leases work for flats, when and how to extend a lease, and the lease problems that most often hold up sales and bank loans.

What a KDA lease is

FeatureWhat it means
LessorKDA, as the authority that planned and allotted the scheme
LesseeThe plot holder named in the lease
TermUsually 99 years from the lease date
DocumentAn indenture of lease, registered at the sub-registrar
Ownership typeLeasehold, not freehold; KDA remains the lessor
Annual chargeGround rent payable to KDA
ConditionsPermitted use, construction, transfer, mortgage and sub-lease rules

A lease is different from an allotment. The allotment order says who was given the plot. The lease is the registered instrument that grants rights over it for a fixed term. Until the lease is executed, the plot exists only as an entry on KDA's file.

An allotment says who was given the plot. A registered lease grants rights over it for a fixed term.

How a lease is executed

  1. Clear all dues on the allotment, including occupancy value and any outstanding charges.
  2. Apply to KDA on its lease execution form.
  3. Pay KDA's lease charges and the cost of the lease indenture.
  4. Pay stamp duty on the lease. In Sindh, a lease of a plot, flat, shop, office or house is charged at 1% of the Board of Revenue valuation table value.
  5. Execute and register the indenture of lease at the sub-registrar.
  6. Keep the registered lease and a KDA certified copy.

KDA's service charges schedule, titled "New Service Charges 2023", lists the lease charges for its schemes. For Scheme 24 (Gulshan-e-Iqbal) and Scheme 36 (Gulistan-e-Jauhar), under a header giving rates per square yard:

ChargeListed rate
Lease chargesRs432
Cost of lease indentureRs6,900 per set
Extension of lease chargesRs518
Addenda or memorandum of leaseListed separately
Surrender and rectification of leaseListed separately
NOC for sub-leaseListed separately
Condonation feeListed separately

Confirm the exact charge for your scheme and plot size with KDA before paying.

What the courts say about a registered lease

A registered KDA lease gives the holder real protection. In a 2017 judgment in Suit No. 1376 of 1997, the Sindh High Court dealt with a North Karachi plot that passed through three pre-lease transfers before KDA executed a registered 99-year lease in 1990. When KDA later tried to cancel the earlier transfer and the lease by letter, the court held that the pre-lease transfer had merged into the registered lease, and that a registered instrument could only be cancelled through proper court proceedings. It restored the buyer's possession.

The practical lesson: a buyer of a leased plot is far safer than a buyer of an unleased one, but only if the lease is genuinely registered and the chain of mutations after it is complete.

Sub-leases: how flat owners hold title

In a KDA scheme, a builder usually holds the lease of the whole plot. Each flat or shop buyer then receives a sub-lease of their unit from the builder or the building's owner.

Two rules govern sub-leases:

  • SBCA's completion plan. Section 18-G of the Sindh Building Control Ordinance bars registration of a sub-lease of newly constructed premises without SBCA's approved completion plan. No completion plan means no registered sub-lease.
  • KDA's NOC. KDA's schedule lists an NOC for sub-lease, so check whether one is needed for your building.

A flat buyer should check three things: the head lease on the plot, the SBCA completion plan for the building, and the registered sub-lease for the unit.

A flat buyer should check three things: the head lease on the plot, the completion plan for the building and the registered sub-lease for the unit.

How long is left on the lease

The remaining term matters to buyers, banks and future buyers. Work it out from the lease date.

Lease executedLease endsYears left in 2026
1965206438
1975207448
1985208458
1995209468
2005210478

Banks increasingly care about this. The State Bank now allows home loans of up to 30 years, as our report on SBP's new housing finance rules explains, and a lender will want the lease to outlast the loan comfortably. A plot with 38 years left may struggle to secure a full-term loan.

Lease extension

KDA lists a separate charge for extending a lease, at Rs518 under the per-square-yard header in its 2023 schedule. Extension is worth considering when:

  • the remaining term is short enough to affect resale value or bank financing;
  • the plot is being redeveloped and the new building will outlast the current lease;
  • a buyer or lender asks for a longer term as a condition.

How to apply:

  1. Confirm the current lease date and remaining term with KDA.
  2. Clear all dues and ground rent.
  3. Apply to KDA for extension and pay the extension charges.
  4. Execute an addendum or fresh lease as KDA directs, and register it.

30-year leases are different

Not every lease in Karachi is a 99-year KDA lease. Some land, particularly government land outside KDA's schemes, has been granted on 30-year leases. Buyers used to other cities' terms should note how different these titles are, a point our comparison of registry, file and plot titles in the twin cities also makes for Islamabad and Rawalpindi. In Suo Motu Case No. 16 of 2011, the Supreme Court ordered on 28 November 2012 that the conversion of 30-year leases into longer terms up to 99 years be stopped immediately. The Sindh High Court has since questioned petitions seeking such conversions in light of that order.

If a seller's papers show a 30-year lease, or a lease "converted" to 99 years, check the conversion's legal basis with a lawyer before paying.

Not every lease is 99 years. Courts have stopped the conversion of 30-year leases into longer terms, so check any converted lease with a lawyer.

What the numbers show: Milkiyat.com findings

Executing a lease on a 240 square yard plot. At the schedule's per-square-yard lease charge: 240 × Rs432 = Rs103,680, plus Rs6,900 for the indenture = Rs110,580 in KDA charges, before stamp duty.

Stamp duty on that lease. On a valuation table value of Rs30 million, lease stamp duty at 1% = Rs300,000, almost three times KDA's own charges.

Extending the same plot's lease. 240 × Rs518 = Rs124,320 in extension charges.

Lease terms vary by four decades. A lease from 1965 has 38 years left, one from 2005 has 78: a gap of 40 years between plots that may look identical on the ground.

Frequently asked questions

Q1. How long is a KDA lease?

A. Usually 99 years from the date the lease is executed.

Q2. Is a KDA plot freehold?

A. No. It is leasehold. KDA remains the lessor, and the holder pays ground rent.

Q3. What does it cost to execute a KDA lease?

A. KDA's 2023 schedule lists lease charges per square yard plus a fixed cost for the indenture, and Sindh stamp duty on a lease is 1% of the valuation table value.

Q4. Can KDA cancel a registered lease?

A. In a 2017 judgment, the Sindh High Court held that a registered KDA lease can only be cancelled through proper court proceedings.

Q5. How do flat owners hold title in a KDA scheme?

A. Through a registered sub-lease from the building's lessee. It needs SBCA's completion plan under section 18-G before it can be registered.

Q6. Can a KDA lease be extended?

A. Yes. KDA lists extension of lease charges in its schedule. Apply after clearing dues.

Q7. Can a 30-year lease be converted to 99 years?

A. The Supreme Court ordered in 2012 that such conversions be stopped. Check any converted lease with a lawyer.

This guide is for general information. Lease terms, charges and procedures change, and buyers should confirm every lease, extension and fee directly with KDA, the sub-registrar and a qualified lawyer before paying.
